Terms of Use - GozAround

This is a legal agreement (“Agreement”) between you and GozAround Inc., a corporation incorporated pursuant to the Business Corporations Act (Canada) (“GozAround”). By accessing the GozAround web site, currently located at http://www.GozAround.com, and using any of the Services accessible through the Site, you become a user and agree to, and are bound by, the terms and conditions of this Agreement. IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT, DO NOT USE THE SITE OR THE SERVICES.

1. Eligibility.

a. Minimum Age.

You must be at least 18 years old to register for the Services.

b. Criminal History.

By using the Service, you represent and warrant that you have never been convicted of an indictable offence and are not required to register as a sex offender.

2. Use of Site and Service.

As a user of the Site or a user registered to use any of the Services ("Registered User"), you agree to the following:

a. Exclusive Use.

Your account is for your personal use only.

b. Geographic Limitations.

The Site and Services are intended for use in Canada.

c. Information Submitted.

You are solely responsible for the information and content you contribute to the Services.

d. Risk Assumption and Precautions.

You assume all risk when using the Services.

e. Reporting of Violations.

You will promptly report to GozAround any violation of the Agreement by others.

f. Content Removal.

GozAround reserves the right to monitor and remove any content that violates this Agreement.

g. Posting and Communication Restrictions.

You will not post content that violates the community guidelines.

h. No False Information.

You will not provide inaccurate, misleading or false information.

i. No Advertising or Commercial Solicitation.

You will not advertise or solicit any user to buy or sell any products or services through the Site or Services.

j. No Harassment of GozAround Employees or Agents.

You will not harass GozAround employees engaged in providing services.

3. Proprietary Rights.

a. Ownership of Proprietary Information.

GozAround owns all proprietary rights in the Services and the Site.

b. No Use of Confidential Information.

You will not post or distribute any proprietary information without consent.

c. Other Users’ Information.

You agree not to copy or commercially use any proprietary information available via the Services.

d. License to Posted Content.

By posting, you grant GozAround and its users a worldwide license to use your content.

4. User Information.

a. Privacy Statement.

By using the Site or the Services, you consent to the terms of GozAround’s Privacy Statement.

b. Disclosure By Law.

GozAround may disclose information you provide if required by law.

c. Disclosure to Protect Abuse Victims.

GozAround reserves the right to disclose any information that suspects abuse.

5. Links to Third-Party Web Sites.

The Services may contain links to third-party sites not under GozAround's control. GozAround is not responsible for the content of such sites.

6. Disclaimer of Warranty.

a. No Warranties.

GozAround provides the Services on an “as is” basis and disclaims all warranties.

b. Third Party Content.

GozAround does not guarantee the accuracy of content from third-party sources.

c. Beta Features.

GozAround may offer new “beta” features with no warranties.

7. Limitation of Liability.

a. Incidental Damages and Aggregate Liability.

GozAround will not be liable for any incidental or consequential damages.

b. No Liability for non-GozAround Actions.

GozAround is not liable for the conduct of other users.

c. Information Verification.

GozAround will have no liability for incorrectly verified information.

8. Indemnification.

You agree to indemnify GozAround for any claims or damages arising out of your use of the Site or Services.

9. Communication and Privacy.

GozAround may use your email address to send notifications about important changes to the Services.

10. Term and Termination.

This Agreement will remain in effect until terminated. Either party may terminate this Agreement at any time.

11. General Provisions.

a. Controlling Law and Jurisdiction.

This Agreement is governed by Alberta law.

b. Miscellaneous.

This Agreement supersedes any prior agreements regarding your use of this Site.
